THE ENGAGEMENT OF PERMANENT STAFF
The Terms and Conditions as set out below are applicable
to Australian Recruiting Pty Ltd.
- In these Terms of Business "engagement" means
employment or use in the following circumstances:
- under a contract of service or for services;
- under an agency, licence, franchise or
partnership;
- in a joint venture agreement or arrangement.
- You will accept these Terms of Business by
interviewing a candidate introduced to you by
Australian Recruiting Pty Ltd.
- The fee payable by you to Australian Recruiting
Pty Ltd for the introduction of a candidate who
subsequently accepts an engagement is calculated as
a percentage of the candidate's gross annual salary
to be received during the first twelve (12) months.
'Salary' includes all payments, superannuation,
bonuses, benefits in kind (including motor vehicle)
and any other payment arising from the engagement.
The Fee is still payable if the candidate is engaged
in a position other than the one originally
intended. No charge whatsoever is made to the
candidate. The total fee charged attracts the
legislated GST.
- You must notify Australian Recruiting Pty Ltd
immediately you engage a candidate whom we have
introduced. You must also inform us of the agreed
salary details, including any bonus and benefits in
kind.
- Australian Recruiting Pty Ltd will make every
reasonable effort to ensure that our candidates suit
your requirements. It is up to you, however, to
satisfy yourself as to the candidate's suitability.
Neither Australian Recruiting Pty Ltd nor anyone
acting on our behalf can accept liability for the
accuracy of any information supplied in relation to
candidates, whether this concerns employment
history, qualifications or personal circumstances or
any other matter whatsoever.
- Australian Recruiting Pty Ltd does not guarantee
that a candidate is available to accept any
engagement.
- Replacement Guarantee:
Australian Recruiting Pty Ltd offers a replacement
guarantee period of three (3) months from the
commencement of the successful candidate's
employment. If for any reason (other than
redundancy/restructure or any change in the original
job specification provided to Australian Recruiting
Pty Ltd at the time of the appointment) the employee
should resign or be terminated within the guarantee
period, Australian Recruiting Pty Ltd undertakes to
provide a replacement candidate.
Australian Recruiting Pty Ltd contractors hired by
the client must be paid for according to the
Australian Recruiting Pty Ltd Engagement of
Contractors Terms of Business.
For your replacement guarantee to be valid and
remain in force, Australian Recruiting Pty Ltd must
be given the opportunity to replace the position and
your account for fees must be paid within fourteen
(14) days of invoice date. Accounts not settled
within this period remain due and payable but the
replacement guarantee does not apply.
If within three (3) calendar months of the
termination your organisation, or any associated
organisation, re-engages the candidate the full Fee
will again become payable.
- The introduction of a candidate by Australian
Recruiting Pty Ltd is confidential. You must not,
directly or indirectly, transfer a Australian
Recruiting Pty Ltd candidate to any other person,
firm or organisation where they are subsequently
engaged in a Permanent or Contract position. If this
happens you will have to pay Australian Recruiting
Pty Ltd the full Fee for the engagement.
- As the Australian Recruiting Pty Ltd permanent
employee is under your direct control, under no
circumstances can Australian Recruiting Pty Ltd be
liable for loss, damage or expense suffered or
incurred by you or any other person, firm or Company
from the introduction or subsequent engagement of a
candidate.
- You will not employ or seek to employ Australian
Recruiting Pty Ltd members of staff. If you do
engage a member of our staff within six (6) months
of their leaving our employment then you will be
liable to pay the full Fee just as if this member of
staff had been introduced as a Australian Recruiting
Pty Ltd candidate.

THE ENGAGEMENT OF TEMPORARY STAFF
The Terms and Conditions as set out below are applicable
to Australian Recruiting Pty Ltd.
- All Australian Recruiting Pty Ltd temporary
employees are assigned under the care, control and
supervision of the customer and the customer is
responsible for all acts, errors and omissions of
Australian Recruiting Pty Ltd employees be they
wilful, negligent or otherwise for the duration of
the assignment.
- The Customer must clearly instruct Australian
Recruiting Pty Ltd on the requirements of the
assignment and duties for the temporary employee.
Australian Recruiting Pty Ltd are to be notified
immediately should there be any change to these
duties or system of work.
- The Customer must provide a safe working
environment and system of work, without risks to
health and such information, instruction, training
and supervision of Australian Recruiting Pty Ltd
temporary employees as necessary to enable them to
perform their work in a manner that is safe and
without risks to health.
- All relevant Award or Agreement conditions apply
and Australian Recruiting Pty Ltd will pay its
employees and invoice the client accordingly.
Australian Recruiting Pty Ltd will pay employees on
the basis of the working hours shown on the
Australian Recruiting Pty Ltd timesheet. The
customer undertakes to have each time sheet
authorised by an appropriate person.
- The hourly rates invoiced to the customer
includes temporary wages and allowances for all
related on-costs where applicable under relevant
legislation eg. Workers Compensation Insurance,
Payroll Taxes, Superannuation, Training etc.
Australian Recruiting Pty Ltd is responsible for
PAYG tax and issue of Group Certificates.
- Overtime or shift work will be invoiced by
Australian Recruiting Pty Ltd in accordance with the
relevant Award or Agreement.
- Any customer-authorised travel during working
hours will be invoiced by Australian Recruiting Pty
Ltd at the hourly rate plus kilometre allowance
designated by the appropriate Award or Agreement.
- All Conditions, bonuses, meal, vehicle or other
allowances and entitlements will be invoiced by
Australian Recruiting Pty Ltd in accordance with the
relevant Award or Agreement. The Client will be
charged a fee at cost plus 10% for Service of
providing a Temporary employee.
- Australian Recruiting Pty Ltd will pay employees
and invoice the customer for such appearance monies
as are designated by the appropriate Award or
Agreement in the event that an assignment is
cancelled or postponed.
- Australian Recruiting Pty Ltd is to be provided
with not less than eight hours notice of
cancellation or postponement of any individual
Australian Recruiting Pty Ltd employee’s assignment.
- All rates and conditions are subject to change
without notice when affected by a variation in Award
or Agreement conditions or statutory on-costs and
will be adjusted from the date designated for
implementation of the variation decision. Australian
Recruiting Pty Ltd invoices will be plus GST.
- Australian Recruiting Pty Ltd provides a
four-hour guarantee. If the customer is in any way
dissatisfied with the temporary supplied there will
be no charge if Australian Recruiting Pty Ltd is
notified within four hours of the commencement of
the assignment.
- Testing and reference checking are carried out
as far as it is practical to do so. Australian
Recruiting Pty Ltd makes every effort to maintain
high standards of integrity and reliability among
our temporary staff. Australian Recruiting Pty Ltd
cannot however accept any responsibility for any
claim, error, loss, expense, damage or delay arising
from any failure to provide staff for all or part of
the booking or from any lack of skill, negligence,
dishonesty or misconduct of the staff provided.
- If the customer employs an Australian Recruiting
Pty Ltd temporary employee on their own staff or any
subsidiary, affiliated or related company, within
six months of the date of completion of the last
Australian Recruiting Pty Ltd assignment by that
temporary employee with the customer, then a
permanent placement fee will apply and be invoiced
to the customer.
- Strictly full payment within 14 days of date of
invoice against weekly invoices to reimburse payment
of temporary wages and all statutory on-costs paid
by Australian Recruiting Pty Ltd on the customer’s
behalf.
